Terms and conditions
John Lewis plc will supply gift vouchers in accordance with these terms and conditions. For the avoidance of doubt all other terms whether contained or referred to in a customers order or in any other document, are hereby excluded.
1. Pricing
Prices include VAT (where applicable) and duty charged at the rates prevailing at the time of going to press on 28 April 2007. All prices shown are correct at time of going to press and exclude delivery charges unless otherwise stated. The brochure supersedes previous John Lewis Corporate brochures.
2. Returning goods
Returns are free of charge and should be made within 28 days of goods being received, excluding gift vouchers and perishable goods which are non-returnable. Full details on how to return your goods will be on the despatch note. Returned goods should be unused and in their original packaging, unless they are faulty.
3. Reproduction
Our graphic designers take care to ensure colours on this website and in our brochure are accurate. The limitations of print production and web screen may mean slight variation. All sizes are approximate.
4. Supply
All mixed wine cases are fully listed in this brochure and every effort is made to supply the items shown. However, in the event of supply diffi culties we reserve the right to make substitutions with similar items of equal or greater value. All items subject to availability. This does not affect your statutory rights. You must be over 18 years of age to order from John Lewis Direct.
5. Licensing Act 2003
Under the Licensing Act 2003 it is an offence to purchase or attempt to purchase alcoholic liquor if you are under the age of 18. We reserve the right to refuse to supply any individual or company.
6. Delivery
We deliver to most UK postcodes, Monday – Friday 9am – 5.30pm (plus Saturdays for flowers). There are a number of postcodes (mainly covering the Highlands and Islands) where we’re not able to deliver flowers. Please check our website for details - we’re sorry for any disappointment. We reserve the right to withhold orders if we believe the delivery address is not secure. Flowers delivery is included in the price; delivery of hampers is FREE per addressee for standard and 'in time for Christmas' delivery (£6.95 for next or named day). Perishable products such as food and flowers may not be returned unless faulty; should your goods arrive damaged, or if you have any complaint, please contact us within 48 hours. Your statutory rights are not affected.
7. Warning
Some products may contain nuts or nut oil.

Gift Voucher terms and conditions
1. Delivery
Whenever possible gift vouchers will be despatched on the day following the day the order was placed subject to that order being received by John Lewis prior to 11am. If an order is received after 11am the vouchers will be despatched within 2 working days. Please note that the date of despatch and delivery to a customer is not of the essence.
All vouchers will be delivered by secure means to the address given by the customer at the time the order was placed. Please note, for all orders over £7,000 delivery may take longer due to the increased security measures which will be put into place.
The customer must notify John Lewis of any discrepancy in a delivery as soon as possible but in any event within 3 days of the delivery of the vouchers.
2. Risk
Risk of loss, destruction or damage to the vouchers remains with John Lewis until delivery to the customer’s address or nominated address where upon risk shall pass to the customer or recipient.
3. Payment
Payment can be made by credit/debit card, cheque, BACS or charged to an existing John Lewis personal or business account. Late payment of invoices will result in the forfeiture of any previously agreed discount on business accounts, and will adversely affect further use of the account. For customers who have purchased vouchers through a John Lewis business account interest at the prevailing rate on the overdue account will be payable. For all other customers interest on overdue accounts will accrue in accordance with the provisions of the late payment of Commercial Debt (interest) Act 1998. If you wish to pay by cheque, BACS or CHAPS, orders will only be fulfilled upon receipt of cleared funds.
4. Gift vouchers
Gift vouchers cannot be used to discharge indebtedness in respect of a John Lewis/Waitrose account card or partnership card™ nor can they be used for the purchase either directly or indirectly of any financial product or service. Gift vouchers may not be redeemed for cash in any circumstances. Vouchers are not sold on a sale or return basis and no return will be permitted unless it can be demonstrated that John Lewis has been in error in fulfi lling the customers order.
5. Discount
Vouchers must not be sold to any third party at a discount without the prior written approval of John Lewis. Please call 0845 603 7979 for the current discount rates or see current Solutions for business brochure.
6. Orders
John Lewis reserves the right to refuse to accept an order and also reserves the right to immediately suspend the fulfilment of an order if the customer is in breach of any of these terms and conditions.
7. Brand protection
No trade mark, service mark, corporate name or other trading name of John Lewis plc or any of its subsidiary companies may be used by a customer without that customer fi rst obtaining the prior written permission of John Lewis. .
8. Variation
John Lewis reserves the right to alter any of the above terms and conditions but undertakes that before so doing it will serve a reasonable notice upon the customer. The customer may not vary the terms and conditions and any attempt to vary these terms and conditions will not be affective unless it is in writing and signed on behalf of John Lewis.
9. Severance
If any of the provisions of this agreement shall be found by any court to be invalid or unenforceable such invalidity or unenforceability shall not affect the other provisions of this agreement which shall remain in full force and effect.
10. Third parties
A person who is not a party to this agreement will acquire no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce or take the benefit of any of these terms and conditions.
11. Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of England and the English courts shall have exclusive jurisdiction.
